These Terms and Conditions (the "Terms") govern your access to and use of the website watermelonn.app and the software applications offered by FusionT4("we", "us" or "our"). By purchasing a plan, installing an app or otherwise using our services, you agree to be bound by these Terms.

1. Services

We provide software applications that install into a merchant's Shopify store to add storefront functionality. The features of each app are described on the relevant product page on this website.

2. Eligibility and accounts

You must operate a valid Shopify store and provide accurate information when purchasing and installing an app. You are responsible for maintaining the confidentiality of any credentials associated with your store and for all activity that occurs under your account.

3. Fees, billing and taxes

Prices for each plan are displayed on this website in Indian Rupees (INR). Payments are collected through our third-party payment partner. Unless stated otherwise, plans are billed as a one-time charge for the selected period and do not renew automatically; you may purchase a new period when your current period ends. Applicable taxes, where charged, are your responsibility.

4. Refunds and cancellation

Refunds and cancellations are governed by our Refund & Cancellation Policy, which forms part of these Terms.

5. Licence and acceptable use

Subject to your compliance with these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable licence to use the app for your own store during your paid period. You agree not to copy, resell, reverse-engineer or attempt to gain unauthorised access to the app or our systems.

6. Intellectual property

All rights, title and interest in the apps, this website and our brand remain with us and our licensors. No rights are granted except as expressly set out in these Terms.

7. Third-party services

Our apps operate alongside Shopify and payments are handled by our payment partner. Your use of those services is subject to their respective terms, and we are not responsible for their acts or omissions.

8. Disclaimers

The services are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, whether express or implied, including fitness for a particular purpose.

9. Limitation of liability

To the maximum extent permitted by law, our total liability arising out of or in connection with the services will not exceed the amount paid by you for the relevant plan in the period giving rise to the claim. We are not liable for indirect, incidental or consequential losses.

10. Termination

We may suspend or terminate your access if you breach these Terms. You may stop using the services at any time by uninstalling the app from your store.

11. Changes to these Terms

We may update these Terms from time to time. The updated version will be posted on this page with a revised "Last updated" date, and continued use of the services constitutes acceptance of the changes.

12. Governing law

These Terms are governed by the laws of India, and the courts at Mumbai, India will have exclusive jurisdiction over any dispute.
